SMS Messaging Terms & Compliance

1. Program Description

This messaging program sends account notifications, flight updates, charter confirmations, Game Day Shuttle alerts, and community messages to members who opt in via web forms or member dashboards. Messages include booking confirmations, reminders, schedule changes, waitlist opportunities, and support communications.

2. Cancellation Instructions

Text "STOP" to the number sending messages to unsubscribe. A confirmation SMS will be sent. To rejoin, sign up again as initially.

3. Support Information

Reply with "HELP" for assistance or contact support@flygameday.com.

4. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates

Message/data rates may apply. Frequency depends on activity and participation.

6. Supported Carriers

Program supports major U.S. wireless carriers including AT&T, T-Mobile, Verizon, and most regional carriers.

7. Age Restriction

Participants must be 18 years or older.

8. Privacy Policy

General Terms

The Site and Platform are owned and operated by Fly Game Day. By using the Site or Platform, creating an account, joining groups, or booking any flight, you agree to these Terms of Service and our Privacy Policy. Terms may change at any time; continued use constitutes acceptance of revised Terms.

Membership & Account Responsibilities

Membership Tiers: Community Access, Priority Membership, Business Membership, REVUP Donor Participation; fees are non-refundable unless stated.
Account Creation: Provide accurate information, maintain login confidentiality, and accept responsibility for account activity.
Community Guidelines: Respect others. Fly Game Day may remove members violating guidelines.

Flight & Travel Services

Role of Fly Game Day: Platform and booking facilitator, not an air carrier. All flights operated by FAA Part 135 certified operators.
Shared Flights & Self-Aggregation: Members may propose or join shared flights. Fly Game Day not liable for disputes or cancellations.
Same Day Game Day XP: Prices are estimates; final pricing confirmed at booking.
Game Day Shuttles: Scheduled shared flights; subject to minimum demand; refunds provided if canceled.

REVUP Program & NIL

REVUP allows athletics departments to generate revenue; projections are not guarantees.
NIL agreements are separate contracts; Fly Game Day is not a party.

Intellectual Property Rights

Fly Game Day materials protected; personal, non-commercial use allowed.
By posting content, you grant Fly Game Day a royalty-free, worldwide license to operate and promote the platform.

Disclaimers & Limitations of Liability

Site and services provided "as is"; no warranties.
Third-party links do not imply endorsement.
Fly Game Day not liable for indirect, incidental, or consequential damages. Total liability limited to amount paid in prior six months.
Users agree to indemnify Fly Game Day for any claims from Terms violations.
