GAMEDAY PRIVATE JETS

Welcome to the Game Day Private Jets ("GDPJ") Community. These Terms govern your access to the GDPJ platform as a Free Access User. These Terms allow you to participate in community demand shaping, browse flights, request quotes, request individual charters, and receive notice of select community events, subject to the limitations set forth below.

⚠️ IMPORTANT NOTICE: AS A FREE ACCESS USER, YOUR ACCESS TO GDPJ IS LIMITED.

YOU MAY REQUEST OR PARTICIPATE IN CERTAIN TRAVEL OPPORTUNITIES, BUT YOU DO NOT HAVE THE RIGHTS OR PRIORITY ACCESS PROVIDED TO PAID OR PRIORITY MEMBERS. YOU MAY GENERALLY PARTICIPATE ONLY AS FOLLOWS:

  • INDIVIDUAL CHARTER REQUESTS: You may request and book individual on-demand charter flights arranged by GDPJ, subject to operator availability, approval, and then-current market pricing.
  • GAME DAY SHUTTLES: You may book seats on designated Public Charter (Part 380) or other Game Day Shuttle offerings when made available to free users; however, such access may be provided on later notice and generally at retail or non-member pricing. Paid/Priority Members may receive earlier access and discounted pricing.
  • MEMBER GUEST TRAVEL: You may travel if invited as a passenger on a Single Entity Charter booked and paid for by a full Member.

YOU MAY NOT JOIN, PROPOSE, ORGANIZE, OR SHARE IN SELF-AGGREGATED SHARED FLIGHTS, CLAIM EMPTY LEGS, OR ACCESS CERTAIN MEMBER-ONLY OR VIP EVENTS UNLESS YOU UPGRADE TO AN ELIGIBLE PAID MEMBERSHIP.

1. LIMITED LICENSE & ELIGIBILITY

GDPJ grants you a limited, revocable, non-exclusive license to access the Community App and Website for the sole purpose of researching travel opportunities and interacting with the Community. You represent that you are at least 18 years old and are providing your true and accurate legal identity. Anonymous accounts, bots, and scrapers are strictly prohibited.

2. NATURE OF SERVICES & BROKER DISCLOSURE

To ensure transparency regarding how our Community operates, you acknowledge and agree to the following regarding GDPJ's role:

GDPJ is an Agent, Not a Carrier: GDPJ acts solely as an authorized agent (broker) in arranging air transportation. GDPJ is not a direct air carrier and does not own or operate aircraft. All flights are performed by FAA-licensed and DOT-registered Direct Air Carriers who exercise full operational control of the aircraft.

Flight Types: The Platform allows you to view and request information on various types of travel solutions. Your ability to book or travel varies by type:

  • On-Demand Charter: Private aircraft arranged specifically for a Charterer. (Free Access Users may request or book individual charters, subject to availability and market rates.)
  • Empty Legs: One-way repositioning flights offered at discounted rates. (Upgrade Required to Book)
  • Self-Aggregated Shared Flights: Flights where Members independently form groups to share the cost of a Small Aircraft (<60 seats or <18,000 lbs payload). (Not available to Free Access Users. Guests may not join, propose, organize, or share these flights.)
  • Public Charters (Part 380): Scheduled Shuttle flights where seats are sold individually. (Free Access Users may book when made available, typically at retail or non-member pricing and sometimes at later notice; Paid/Priority Members may receive earlier access and discounted pricing.)

2.1. GUEST PARTICIPATION, EVENTS & TIER LIMITATIONS

While your access as a Free Access User is limited, you may participate in certain flights or community experiences under the following specific conditions:

  • Guest on Single Entity Charter: You may travel as an invited passenger on a flight chartered by a full Member. You acknowledge that the chartering Member is solely responsible for the flight cost and adherence to contract terms.
  • Guest on Shared Flight (Guest Pass): You may be invited by a "Host Member" to join a Self-Aggregated Shared Flight using a "Guest Pass." By accepting, you acknowledge that your participation is subject to the Host Member's valid pass allotment and Game Day's Guest Payer Terms of Carriage, which includes mandatory DOT disclosures. If you pay a portion of the costs, you agree such payment is made strictly on behalf of the Host Member.
  • Public Charter / Shuttle Booking: From time to time, GDPJ may offer "Public Charter" flights (Shuttles) or similar Game Day Shuttle services open to the general public or otherwise made available to Free Access Users. Free Access Users are permitted to book these specific flights only when offered by GDPJ, subject to then-applicable retail or non-member pricing, potential late-notice access, and the specific Operator-Participant Agreement or other governing terms, including any disclosures required under 14 CFR Part 380.

No Guarantee of Availability or Pricing: Estimated Charter Costs, Shuttle pricing, access timing, event invitations, and flight availability shown to Guests are based on historical data, third-party operator availability, and real-time market conditions. They are estimates only and do not constitute a firm offer of transportation, event access, or a per-seat fare except where specifically confirmed by GDPJ in writing for a designated Shuttle or other offering. All costs, availability, and access rights are subject to change without notice until confirmed.

Event Access; Member Priority: Free Access Users may be invited to attend certain GDPJ community events, activations, or informational experiences as determined by GDPJ in its sole discretion. Access is not guaranteed. Certain events, premium activations, hosted experiences, or VIP events may be reserved exclusively for Paid, Priority, Family, Business, Founding, or other eligible membership tiers.

3. GAME DAY PRIVATE JETS IMPACT FUND

Game Day Private Jets, LLC ("GDPJ") may, in its sole discretion, allocate a portion of certain charter revenues to charitable initiatives, athletic department partnerships, name, image, and likeness (NIL) programs, or other community impact efforts administered by GDPJ, including through the Game Day Private Jets Impact Fund ("Impact Fund").

Participation in any GDPJ membership program does not entitle a Member to direct, control, receive, or claim any portion of Impact Fund allocations, nor does it create any fiduciary duty, rebate, refund, or revenue-sharing obligation. All Impact Fund allocations are determined exclusively by GDPJ and may be modified, suspended, or discontinued at any time.

4. DATA RIGHTS, DEMAND SHAPING, AND MARKETING CONSENT

By registering as a Guest, you acknowledge that the core value of the Community is the aggregation of member demand to secure better aviation pricing. As such, you agree to the following data practices:

Demand Aggregation: You grant GDPJ a perpetual, worldwide, royalty-free license to use your search history, "watch lists," flight requests, and empty leg interests to aggregate demand. GDPJ may use this data to negotiate with operators, create new flight routes, or publish "suggested flights" to the Community based on your inputs. You acknowledge you have no ownership rights in any flight route or schedule created by GDPJ using your data.

Empty Leg Alerts: Additionally, you may subscribe to "Custom Empty Leg Alerts" to receive notifications about specific routes. You acknowledge that these alerts are for informational purposes only, are not guaranteed, and subject to final pricing confirmation and availability. You must upgrade to a Full Paid Membership to claim or book any advertised Empty Leg.

Marketing Consent: You expressly consent to receive commercial communications from GDPJ and its partners via email, text message (SMS), and push notifications regarding flight offers, membership upgrades, and partner benefits. You acknowledge that receiving these alerts is a condition of your access to the Community. While you may opt-out of specific marketing channels as required by law, excessive opt-outs may result in the suspension of your Guest privileges if it prevents GDPJ from delivering Community notifications.

"Intent to Fly" Data: GDPJ reserves the right to treat your specific flight requests as "high-intent" signals. We may share limited details of your request (e.g., "Client seeking VNY-LAS, Dec 12") with select Operator networks to source pricing, provided your personal identity remains confidential until a booking is initiated.

5. COMMUNITY CONDUCT & "GOOD FAITH"

The Game Day Community relies on trust and cooperation. By registering, you agree to:

  • No "Bad Faith" Requests: You generally agree to request quotes, charter options, Shuttle seats, or express interest in travel only when you have a genuine interest in booking or participating. Repeatedly requesting complex quotes or access with no intention to proceed (as determined by GDPJ) constitutes wasting Community resources and may result in immediate account termination.
  • Respectful Interaction: You agree to the Code of Conduct (no harassment, discrimination, or abusive language) when interacting with GDPJ staff or other members in community forums.
  • No Solicitation: You may not use the platform to solicit other members for business, sell other services, or recruit for competing aviation programs.

6. COMMUNITY GOVERNANCE, COMPLIANCE & MODERATION POLICY

As a condition of registering for and accessing the Game Day Private Jets Community as a Free Access User, you acknowledge and agree to comply with the Game Day Community Governance, Compliance & Moderation Policy (the "Governance Policy"), as may be updated from time to time by Game Day Private Jets ("GDPJ") and Terms of Service: https://flygameday.com/terms-of-service/. The Governance Policy governs member conduct, permissible use of the Community, moderation standards, and compliance boundaries, and is incorporated by reference into these Community Access Terms as if fully set forth herein. By registering for a free Community account, accessing the Community, or continuing to participate in Community features, you expressly acknowledge that you have read, understood, and agree to be bound by the Governance Policy. GDPJ reserves the right, in its sole discretion, to restrict, suspend, or terminate your Community access for violations of the Governance Policy or these Community Access Terms, without notice and without liability.

7. VERIFICATION & FRAUD PREVENTION

To protect the integrity of the Community, GDPJ reserves the right to verify your identity at any time. We may require you to upload a government ID or verify a phone number before releasing specific pricing or flight details. Failure to verify will result in suspension of Guest privileges.

8. INTELLECTUAL PROPERTY

All pricing, flight availability data, and member lists are the proprietary trade secrets of GDPJ. You agree not to copy, scrape, or share this data with third parties or competitors.

9. TERMINATION; DISCONTINUATION OF FREE TIER

GDPJ reserves the right to restrict, suspend, or terminate your Guest access at any time, for any reason, particularly for violations of these Terms, the Governance Policy, or the Conduct and Good Faith rules above. In addition, GDPJ may modify, discontinue, or cancel the Free Membership / Free Access User tier entirely in its sole discretion upon thirty (30) days' prior notice to affected users. GDPJ shall have no liability arising from any such suspension, termination, modification, or discontinuation.

10. NO LIABILITY FOR SERVICES

As a free user, you acknowledge that GDPJ provides the Community platform "AS IS" and disclaims all warranties. GDPJ shall have no liability to you for any errors in pricing, flight availability, the conduct of other members, or the inability to fulfill a flight request.
